Release of Liability and Indemnification Agreement

This Release of Liability and Indemnification Agreement (“Agreement”) is entered into by and between the undersigned renter (“Renter”) and Sunryde, as well as the Host of the rented vehicle. By signing this Agreement, the Renter acknowledges and agrees to the following:

1. Assumption of Risk:

The Renter acknowledges that renting and riding a micromobility vehicle involves inherent risks, including the risk of personal injury, property damage, or theft. The Renter voluntarily assumes all risks associated with the rental and operation of the vehicle.

2. Release of Liability:

The Renter releases Sunryde, the Host, and any affiliates, officers, directors, employees, or agents from any and all liabilities, claims, damages, or causes of action arising out of or related to personal injury, property damage, theft, or loss that occurs during the rental period, whether caused by the Renter’s negligence or not. This release includes, but is not limited to, injuries caused by improper operation or failure to follow local laws and regulations.

3. Responsibility for Theft:

The Renter acknowledges responsibility for the security of the rented vehicle. The Renter must lock the vehicle as instructed and ensure it is stored safely when not in use. Failure to follow security protocols may result in the Renter being held fully liable for theft of the vehicle.

4. Reporting Theft and Damage:

In the event of theft or damage to the vehicle, the Renter must immediately contact the Host and Sunryde to report the incident. Sunryde can be reached at theft@sunryde.com. A police report must be filed within 6 hours of discovering the vehicle is missing. The Renter agrees to return any original keys to the Host if available.

5. Indemnification:

The Renter agrees to indemnify and hold harmless Sunryde, the Host, and their respective affiliates, employees, and agents from any and all claims, damages, liabilities, or expenses, including third-party claims related to intellectual property disputes, personal injuries, or damages arising from the Renter’s use of the vehicle.

6. Waiver of Claims:

The Renter waives any right to bring claims against Sunryde or the Host for any accidents, injuries, or damages that occur while using the vehicle, including claims related to vehicle defects or unsafe conditions.
