Release of Liability and Indemnification Agreement

This Release of Liability and Indemnification Agreement (“Agreement”) is entered into by and between the undersigned Host (“Host”) and Sunryde. By signing this Agreement, the Host acknowledges and agrees to the following:

1. Assumption of Risk:

The Host acknowledges that listing a micromobility vehicle on the Sunryde platform involves certain risks, including the risk of property damage, theft, or liability claims arising from the use of the vehicle by Renters. The Host voluntarily assumes all risks associated with listing their vehicle on the platform.

2. Release of Liability:

The Host releases Sunryde and its affiliates, officers, directors, employees, or agents from any and all liabilities, claims, damages, or causes of action arising out of or related to theft, damage, or loss of the vehicle during the rental period. This release includes, but is not limited to, any claims arising from the Renter’s improper or unsafe use of the vehicle.

3. Responsibility for Theft:

The Host acknowledges that Sunryde provides tools to assist in locating stolen vehicles, but does not guarantee recovery or compensation for theft. The Host is responsible for obtaining theft insurance to cover potential losses.

4. Insurance Coverage:

The Host agrees to maintain adequate insurance coverage for theft, damage, and third-party liability related to their listed vehicles. Sunryde will not be held liable for any losses or claims that arise due to the Host’s failure to secure adequate insurance.

5. Reporting Theft and Damage:

In the event of theft or damage, the Host must immediately contact Sunryde and file a police report. Sunryde will provide tracking assistance, but the Host acknowledges that recovery is not guaranteed. The Host is responsible for any unrecovered losses.

6. Indemnification:

The Host agrees to indemnify and hold harmless Sunryde and its affiliates, employees, and agents from any and all claims, damages, liabilities, or expenses, including third-party claims related to intellectual property disputes, personal injuries, or damages arising from the Host’s failure to properly maintain, insure, or secure their vehicle.

7. Vehicle Maintenance and Documentation:

The Host is responsible for maintaining their vehicle in a safe and operable condition. The Host must document the vehicle’s condition before and after each rental period and submit any required evidence in case of disputes over damages.

8. Waiver of Claims:

The Host waives any right to bring claims against Sunryde for any theft, damages, or losses that occur during the rental period, including claims arising from the actions of Renters or third parties.
